The Rachael Ray Yum-o! Cooking Camp powered by Food Network & Cooking Channel New York City and South Beach Wine & Food Festivals (“Festival”) presented by Capital One® is hosted by Florida International University. This ticket is a revocable license.
A legal guardian or parent of all minor children under 18 years of age (the “Child”) hereby certifies that he/she is the adult parent or guardian of the Child and agrees to take full responsibility for the Child’s safety and supervision during the Child’s participation in the Event (as described below). The holder of the ticket (“Holder”) on behalf of himself and/or his Child, agrees to all of the terms hereof. By registering to attend the event and entering the Zoom meeting for which you register (“Event”), the Holder on behalf of himself and/or his Child, agrees to be bound by all of the terms and conditions of this license.
Virtual Booking Policy
Bookings will open at least 24 hours days before the session starts.
Bookings close one hour before the session starts.
Reservation Policy
Classes are reserved by completing the online ticket order form and are subject to the terms and conditions contained in the form. Optional donations will be processed at time of registration. Once Holder completes the registration, Rachael Ray’s Yum-o! Cooking Camp will email Holder’s registration confirmation along with directions to access the Zoom video link. Please notify Rachael Ray’s Yum-o! Cooking Camp immediately if Holder does not receive a confirmation email. Participants are responsible to ensure they receive registration confirmation.
ALL SALES FINAL; NO REFUNDS, NO EXCHANGES, NO REPLACEMENTS; RESALE:
All events, prices, personalities, performances, venues, dates and times are subject to change without notice. All sales are final. This ticket and/or optional donation will not be replaced, refunded or exchanged for any reason whatsoever. Festival reserves the right to refuse admission and to revoke the ticket at any time.
ASSUMPTION OF ALL RISKS, WAIVER AND RELEASE:
Holder understands and admits that his/hers/Child’s participation in the Event is voluntary.
BY USING THIS TICKET, THE HOLDER FOR HIMSELF AND/OR THE CHILD ACKNOWLEDGES AND UNDERSTANDS THE DANGERS AND RISKS INHERENT IN SUCH ACTIVITIES RELATED TO PREPARING FOOD AND DRINKS, CONSUMING CERTAIN FOODS AND DRINKS, AND WORKING WITH TOOLS, EQUIPMENT AND APPLIANCES. HOLDER IS RESPONSIBLE FOR MAINTAINING THE QUALITY OF THE FOOD HOLDER AND/OR THE CHILD PREPARES, COOKS AND EATS DURING ANY CLASS OR AFTER ANY CLASS. HOLDER ALONE IS RESPONSIBLE FOR PROTECTING AGAINST ALLERGIC REACTIONS PERTAINING TO THE CONSUMPTION OF FOOD OR DRINK. HOLDER FOR HIMSELF AND/OR CHILD VOLUNTARILY ASSUMES ALL RISKS AND DANGERS OF PERSONAL INJURY ARISING FROM, INCIDENTAL TO, OR RELATED IN ANY WAY TO THE EVENT, WHETHER OCCURRING PRIOR TO, DURING, OR AFTER THE EVENT, HOWSOEVER CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE.
IN CONSIDERATION OF HOLDER AND/OR CHILD’s ABILITY TO PARTICIPATE IN A CLASS OR ACTIVITY, HOLDER FOR HIMSELF, CHILD, THEIR HEIRS, EXECUTORS AND ASSIGNS HEREBY EXPRESSLY AGREES TO RELEASE FESTIVAL ORGANIZERS, ITS BOARD OF TRUSTEES, STATE OF FLORIDA, THE FLORIDA BOARD OF GOVERNORS, RACHAEL RAY DIGITAL LLC, RACHAEL RAY, JOHN CUSIMANO, YUM-O,HOSTS, AND SOUTHERN GLAZERS WINE AND SPIRITS, AND EACH OF ITS RESPECTIVE OFFICERS, DIRECTORS, TRUSTESS, OWNERS, BENEFICIARIES, AFFILIATES, EMPLOYEES, VOLUNTEERS AND AGENTS (COLLECTIVELY, “RELEASEES”) FROM AND AGAINST ANY AND ALL DEMANDS, CLAIMS, LOSSES, INJURY, DAMAGES, LIABILITY, ATTORNEY FEES, COSTS, AND/OR EXPENSES OF LITIGATION, IN LAW OR IN EQUITY, WHETHER KNOWN OR UNKNOWN, ARISING FROM OR RELATING TO, OR OTHERWISE OCCURRING AT OR IN CONNECTION WITH THE EVENT, INCLUDING BUT NOT LIMITED TO: HOLDER AND/OR CHILD’S PARTICIPATION IN THE EVENT, OR FROM HOLDER AND/OR CHILD’S USE OF ANY RECIPE, SKILL, TECHNIQUE, TOOL, OR METHOD USED OR LEARNED DURING THE EVENT OR OUT OF HOLDER AND/OR CHILD’S BREACH OF THESE TERMS AND CONDITIONS OR THE DOCUMENTS THEY INCORPORATE BY REFERENCE, OR HOLDER AND/OR CHILD’S VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD-PARTY. HOLDER, FOR HIMSELF, CHILD, THEIR HEIRS, EXECUTORS AND ASSIGNS PROMISES NOT TO SUE ANY OF THE RELEASEES FOR SUCH DEMANDS, CLAIMS, OR LIABILITY.
IN NO CASE SHALL THE RELEASEES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM HOLDER AND/OR CHILD’S PARTICIPATION IN THE EVENT, USE OF ANY RECIPE, SKILL, TECHNIQUE, TOOL, OR METHOD USED OR LEARNED DURING THE EVENT, USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED DURING THE EVENT, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO HOLDER AND/OR CHILD’S PARTICIPATION IN THE EVENT, USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE PARTICIPATION IN THE EVENT OR ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE DURING THE EVENT, EVEN IF ADVISED OF THEIR POSSIBILITY.
PROHIBITED CONDUCT AND ITEMS:
For privacy purposes, and to protect Rachael Ray’s Yum-o! Cooking Camp intellectual property, Holder and/or the Child may not make video, audio, or any other recordings of any of Rachael Ray’s Yum-o! Cooking Camp classes or activities.
Holder for himself and/or the Child agrees not to transmit, distribute, or sell (or aid in transmitting, distributing, or selling), any media now or hereafter existing, any description, account, picture, video, audio or other form of reproduction of any Event action, Event information, Event guest or attendee, or any surrounding activities (in whole or in part) for the Event. This ticket may not be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes, without the express written consent of Festival Organizer.
INFORMATION COLLECTION AND RIGHT TO USE HOLDER AND CHILD’S NAME, VOICE, IMAGE AND LIKENESS:
By using this ticket, Holder for himself and/or the Child hereby grants Organizers (Rachael Ray’s Yum-o! and Food Network & Cooking Channel New York City and South Beach Wine & Food Festivals presented by Capital One and their affiliates, designees and licensees the irrevocable, worldwide, transferable, perpetual right and license to record (by photograph, film, tape, aural devices and any other method or device) the Holder and/or Child’s name, voice, image and likeness while participating in the Event (the “Recordings”) and to publish, print, display, or use such recordings for any and all purposes in any medium, including commercial or promotional purposes, and/or in connection with the missions of the organizers generally, without further authorization or compensation. We collect information from you when you register on our site. When registering on our website, as appropriate, you will be asked to enter your: name, e-mail address, age of participant and zip code. When you sign in to Zoom for the Event, your name and e-mail address will be collected. You may, however, visit our site anonymously.
The email address you provided may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc. Note: if at any time you would like to unsubscribe from receiving future emails we include detailed unsubscribe instructions at the bottom of each email.
Recipes and Other Content
Recipes will be given to participants for the food items produced. Recipes are and remain the intellectual property of Rachael Ray’s Yum-o! Cooking Camp and Holder and/or Child may not use Rachael Ray’s Yum-o! Cooking Camp recipes for any commercial use. Rachael Ray’s Yum-o! Cooking Camp reserves the right to take judicial action to prevent any unauthorized use of the recipes.
Furthermore, the Event contains other content which includes without limitation images, illustrations, designs, icons, photographs, video clips, sounds, text, data and other materials displayed or available during the Event (the “Content”) that is protected by copyright, trademark, trade dress, and/or other proprietary rights of the Festival Organizer and third-party content providers (all parties, including Festival Organizer are singly and collectively the “Providers”). Furthermore, all trademarks, service marks, and trade names contained in the material and otherwise displayed during activities and/or classes (“Marks”) are the property of Festival Organizer or other third parties. Holder and/or the Child are not permitted to use the Marks. Holder and/or the Child’s participation in the Event does not grant to Holder and/or the Child ownership of or any other rights with respect to any Content and/or Marks. Festival Organizer reserves all rights regarding the Content and/or Marks. Holder for himself and/or the Child agrees to comply with any and all restrictions regarding use of the Content.
Necessary Equipment and Ingredients
Holder for himself and/or the Child is solely responsible for obtaining and maintaining all equipment and tools necessary to access and use our services, and must pay all third party fees associated with Holder and/or Child’s use of the services. As our services allow Holder to participate in video conferences over the Internet, Holder is solely responsible for obtaining and maintaining the necessary hardware/software and internet/telecommunication service to connect to our website and to participate in a high definition video conference over the Internet (including but not limited to, sufficient Internet data plans, web cameras, speakers and computer processing systems). Holder is responsible for checking with Holder’s provider(s) to determine whether there are any such fees that may apply to Holder. In no event will we reimburse Holder and/or the Child for delays, interruptions or failures of Holder’s third-party suppliers and providers and Holder is solely responsible for ensuring the adequacy and sufficiency of all tools and equipment.
Governing Law/Venue
These Terms and Conditions and any separate agreements whereby Festival Organizer offer any activity shall be governed by and construed in accordance with the laws of the State of Florida without regards to its conflicts of law principles. Exclusive venue of any actions shall be in Miami-Dade County, Florida. The Festival Organizer is entitled to the benefits of sovereign immunity.

Rachael Ray’s Yum-o! Cooking Camp uses Zoom software as the software to produce each episode. Please refer to Zoom’s Terms and Conditions, Reasonable Use Policy and Privacy Agreements for additional questions.
